1) Introduction

Welcome to Napa Valley Supercars LLC. These Terms and Conditions govern your use of our website located at www.napavalleysupercars.com and our services.

2) Acceptance of Terms

By accessing our website and using our services, you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, then you do not have permission to access the service.

3) Services Description

Napa Valley Supercars provides exotic supercar experiences where you get to drive on an open road guided tour. Detailed descriptions of the services are available on our website.

4) User Responsibilities

• Drivers participating in Supercar Canyon Tours must be at least 23 years old and under 65 years old.

• Drivers participating in Supercar Rentals must be at least 25 years old and under 65 years old.

• You agree to follow all safety instructions and guidelines provided by Napa Valley Supercars at all times.

• You are responsible for any damage caused to the vehicles whilst you are driving.

• All drivers must provide their Comprehensive Automotive Insurance Declaration Page with a minimum coverage of $100,000/$300,000/$100,000.

• Insurance declaration details are recommended to be submitted 14 days prior to your tour or rental date, and must be received no later than 48 hours before your scheduled start time. Failure to provide insurance documentation within 48 hours will result in cancellation of your booking.

• Drivers will need to provide their driver's license and agree to a Motor Vehicle Records (MVR) check. An MVR check showing major violations may result in your booking being refused or cancelled.

• Maximum height is 6’4” and maximum weight is 350 lbs for all participants.

• Passengers must be at least 14 years old and a minimum of 54" tall. Participants under the age of 18 must have a legal guardian sign the waiver on their behalf.

5) Bookings

• All supercar canyon tours are priced “per seat” and based on double occupancy. The majority of our guests purchase two seats to ensure they have the whole car to themselves.

• All participants have the opportunity to drive. If you purchase two seats and the passenger does not want to drive, the benefit is that you will then receive double the driving time!

• If you purchase for one seat you will be paired up with another paying guest and rotating at checkpoints with equal drive time.

• Reservations for tours must be made in advance.

6) Cancellations

• Bookings can be rescheduled with 7 calendar days notice prior to the scheduled tour or rental date.

• If a tour or rental is cancelled by Napa Valley Supercars for any reason, including unsafe weather conditions, a full account credit will be provided.

• If a participant cancels their booking within 7 calendar days of the scheduled tour or rental date, a full account credit will be provided.

• Account credits can be applied to any future booking and are valid for three years from the original tour or rental date.

• Napa Valley Supercars reserves the right to cancel or terminate a tour or rental at any time if a participant fails to comply with safety guidelines, rules, or the Code of Conduct outlined in these Terms and Conditions.

7) Refund Policy

• Napa Valley Supercars does NOT provide monetary refunds under any circumstances, including but not limited to cancellations by the participant, no-shows, early departures, medical reasons, discounts or changes in online pricing, or changes in personal circumstances.

• In the event that Napa Valley Supercars cancels a tour or rental, a full account credit will be issued. In the event that a participant cancels within 7 calendar days of the scheduled tour or rental date, a full account credit will be issued.

• Account credits may be applied to any future booking and are valid for three years from the original tour or rental date. Credits are non-transferable and have no cash value.

• Third-party purchasers (including gift card recipients and third-party booking platforms) are subject to the refund and credit terms of the respective third party.

8) Late Arrival Policy

• A grace period of 10 minutes from the scheduled tour or rental start time is provided.

• Failure to arrive within 10 minutes of the scheduled start time will result in a forfeit of your booking and full payment, with no account credit issued.

• Napa Valley Supercars is not liable for any loss incurred as a result of late arrival by the participant.

9) Driver Substitution

• If the originally nominated driver is unable to attend, a substitute driver may be nominated provided that:
  (a) the substitute driver meets all driver requirements including age, valid driver's license, MVR check, and insurance coverage;
  (b) the change is requested no later than 7 calendar days before the scheduled tour date; and
  (c) revised insurance documentation for the substitute driver is submitted no later than 48 hours before the scheduled start time.

• Driver substitution requests must be made by contacting Napa Valley Supercars by phone at (707) 927-2014 or by email at drive@nvstours.com.

10) Medical Restrictions

• For the safety of all participants, you should not book or participate in a tour or rental if you have or are experiencing any of the following conditions:

  • High blood pressure

  • Susceptibility to motion sickness

  • Heart, neck, or back issues

  • Recent surgery or a medical condition that could be aggravated by the experience

  • Pregnancy

  • Sight or hearing impairment

• Napa Valley Supercars reserves the right to refuse participation to any individual who, in the reasonable opinion of NVS staff, presents a safety risk to themselves or others.

• No refund or credit will be issued where participation is refused on medical or safety grounds not disclosed at the time of booking.

11) Code of Conduct and Vehicle Use

All drivers and passengers must comply with the following rules at all times:

• All participants must follow safety procedures and guidelines as instructed by Napa Valley Supercars staff throughout the experience.

• Passing the lead/pace vehicle is strictly prohibited, except where required by road conditions or overall safety (e.g. pulling over for emergency vehicles). Any participant who passes the lead vehicle under any other circumstances will have their tour immediately terminated. The participant will be instructed to pull over at the next safe location and the vehicle will be reported as stolen to local police. Insurance coverage will be voided.

• Eating, drinking, and smoking or vaping inside any vehicle is strictly prohibited at all times.

• No alcohol is permitted on any tour or during any rental period.

• All traffic laws and road rules must be observed at all times. Any speeding tickets, traffic violations, or fines incurred during a tour or rental period are the sole responsibility of the participant.

• Napa Valley Supercars reserves the right to revoke a participant's tour or rental experience without refund or credit if these guidelines are not followed.

12) Supercar Rental Specific Terms

The following additional terms apply to all Supercar Rental bookings:

• A minimum rental period of 24 hours applies to all supercar rentals.

• A mileage allowance of 75 miles per day is included in the rental price. Additional mileage charges apply beyond this allowance. Please refer to the Supercar Rental page for vehicle-specific rates.

• A refundable security deposit is required at the time of booking. The deposit will be returned following safe return of the vehicle and inspection for damage and compliance with the Vehicle Rental Agreement. Security deposit amounts are listed on the Supercar Rental page.

• Late returns will incur additional charges in half-day increments. Participants who anticipate a delay must notify Napa Valley Supercars immediately.

• Rental vehicles may not be taken off paved roads, used on a race track, or driven outside the state of California. Any use of the vehicle in an unauthorized manner will void insurance coverage and result in forfeiture of the security deposit.

• All rental vehicles are fitted with onboard vehicle monitoring systems to ensure safe and responsible use at all times.

• In the event of an accident or damage during the rental period, the participant must notify Napa Valley Supercars immediately. Repair costs may be deducted from the security deposit or covered by the participant's insurance.

13) Payment Terms

• Full payment is required prior to the commencement of the tour.

14) Limitation of Liability

Napa Valley Supercars is not liable for any accidents, injuries, or damages that occur during the tours, except to the extent such liability arises due to our negligence or willful misconduct.

All drivers must provide details of their comprehensive automotive insurance (ie declaration page) for review and approval by Napa Valley Supercars prior to the tour.

15) Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Napa Valley Supercars and is protected by intellectual property laws.

All vehicle manufacturer logos (ie Ferrari, Lamborghini, McLaren, Porsche, Aston Martin and AMG) are the copyright and intellectual property of their respective organizations.

16) Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. We will notify you of any changes by posting the new Terms and Conditions on this page.

17) Governing Law

These Terms shall be governed and construed in accordance with the laws of California in which Napa Valley Supercars operates.
